Terms of Service
SilverRack ("the company") will try and make this easy. The customer ("you") is agreeing to obey the following:
- Failure to comply with the Terms of Service will result in the immediate termination of the account.
- You may not host or use the company for any business that is considered illegal by any applicable U.S. or international law.
- You may not send unsolicited email (spam) from your account.
- You may not run any game servers, IRC servers, IRC Clients, or Proxies.
- The company reserves the right to terminate any accounts that are utilizing too much disk activity or an unfair amount of resources.
- The company may reboot any hardware at anytime without notice. If it needs to happen, the company will make an attempt to notify you before performing any server maintenance.
- The company will make every attempt to keep the service available, but does not offer a service level agreement ("SLA"). If it is not available for some period of time, you may request a partial refund of your monthly subscription price.
- You are responsible for your own data and the security of your own VPS.
- In general the company prefers to treat your data as private; however as a pragmatic matter the company cannot be absolute about this. The company reserves the right to monitor any content and services on your VPS to ensure compliance with Terms of Service. The company will give your data to legal authorities if subpoenaed.
- All plans are month-to-month. You will be billed each month until either party terminates the agreement. Either party may terminate service at anytime, without penalty. The company will attempt to give adequate notice for you to save your data before terminating any accounts.
- If you exceed your bandwidth in a given month, you will be billed $5 per gb used over your plan's allocated amount for that month.
- All IP addresses remain the property of SilverRack and are non-transferable.
- This Terms of Service may be changed at anytime without notice. Upon change, the company will email a copy of the new Terms of Service, and if you do not cancel your account within 7 days you will be deemed as having accepted it.
- THE COMPANY SERVICES ARE OFFERED WITH NO WARRANTY OR GUARANTEES.
- THE COMPANY IS NOT RESPONSIBLE FOR ANY LOSS OF DATA OR DAMAGES FROM RESULTING LOSS. THE COMPANY WILL NOT BE HELD LIABLE FOR ANY AMOUNT.
